Suppose the offending provision cannot be so limited. In that case, the same shall be deemed stricken from the Agreement in its entirety, and the remainder of this Agreement shall survive with the said offending provision eliminated.
Website Availability. Because public networks, such as the internet, occasionally experience disruptions, Clarity Counseling, LLC cannot guarantee the Site will be available 100% of the time. Although Clarity Counseling, LLC strives to provide the most reliable website possible, interruptions and delays in accessing the Site are unavoidable. Clarity Counseling, LLC disclaims any liability for damages resulting from such problems.

Termination: Clarity Counseling, LLC may cancel or terminate your right to access or use any site part without notice. Venue of any action brought to enforce or relating to this Agreement or arising out of the relationship between the parties shall be brought exclusively in the Johnson County Kansas District Court or the United States District Court for the District of Kansas.
CLARITY COUNSELING, LLC HIPAA-compliant electronic ‘Intake Forms’: By providing your information and the client’s information using a HIPAA (Health Insurance Portability and Accountability Act) compliant third-party electronic form and “clicking” and submitting private, sensitive client information to conduct a client benefits investigation, you are requesting to start services described on this form. The information you provide will only be used by Clarity Counseling, LLC in delivering products and services.

By providing the information and submitting this form, you indicate you read, understand, and agree to these terms. Third-party service providers provide client insurance benefits investigation and other CLARITY COUNSELING client program offerings. Clarity Counseling, LLC assists healthcare providers in determining whether treatment could be covered by the applicable third-party payer based on coverage guidelines provided by the payer and client information provided by the healthcare provider under appropriate authorization following the provider’s exclusive determination of medical necessity. This information is made available as a convenience to clients, and clients or HCPs are not required to use any Clarity Counseling, LLC service or product in exchange for this information. Clarity Counseling, LLC assumes no responsibility for and does not guarantee the information’s quality, scope, or availability. The third-party service providers, not Clarity Counseling, LLC Services, are responsible for the benefits and other health insurance information provided. Each HCP and client are responsible for verifying or confirming information provided to Clarity Counseling, LLC representatives.
All claims and other submissions to payers should follow all applicable requirements.
